Criminal Capacity

Our opinion of criminal capacity is determined by whether an accused understands the difference between right and wrong, as well as whether he/she was able to apply, and act according to this understanding at the time of the commission of the offence. An in-depth analysis of the accused’s psychosocial and cognitive functioning is conducted before an opinion is formed.
